How to Launch a Crypto Casino in the US: Legal Limits 2026

·

Updated October 2026

This guide is for general information and is not legal advice. Confirm your plan with your own gaming counsel before you launch.

Short answer: In the US, crypto does not change which gambling rules apply. A real-money crypto casino needs state-level authorization in each state where players are located, and federal payment and money-transmission rules still apply. Crypto only changes the payment rail. Sweepstakes-style models follow a different legal framework, which you should review with counsel before launch.

Does crypto change the legal rules for a US casino?

No. The law looks at the bet, not at the currency used to fund the account. The federal Unlawful Internet Gambling Enforcement Act (UIGEA) defines unlawful internet gambling as placing, receiving or knowingly transmitting a bet or wager, using the internet at least in part, where that bet is unlawful under any applicable federal or state law in the state or tribal lands where it is initiated, received or otherwise made. You can read the text in the Federal Reserve Regulatory Service copy of the Act.

In practice, the question is always the same: is this activity authorized in the state where the player sits? If it is not, accepting Bitcoin or a stablecoin instead of a card does not fix it. Offering crypto deposits to players in a state where your product is not authorized adds a payment channel to a legal problem you already have.

What are the main legal limits on a US crypto casino?

Four limits come up in almost every launch plan.

  • State authorization. Gambling is regulated state by state. Washington State, for example, says that all gambling is illegal unless specifically authorized by law, and that games of chance that ask players to wager virtual currency for the chance of winning more virtual currency are likely to constitute illegal gambling. See the Washington State Gambling Commission statement on virtual casinos.
  • Player location. Your obligations follow the player. A brand that is open to every US state needs a plan for each state it serves and each state it blocks.
  • Federal payment rules. UIGEA sits on top of state law, so the payment processors and banks you rely on will ask which states you serve and on what authority.
  • Money transmission. If your model involves administering or exchanging convertible virtual currency, FinCEN rules may apply to you. Its 2013 guidance states that a user of virtual currency is not a money services business, while an administrator or exchanger is a money transmitter unless a limitation or exemption applies. Read the FinCEN guidance (FIN-2013-G001).

Which launch paths exist for a crypto casino in the US?

There are several paths, and they have different rules, costs and timelines.

Path Who authorizes it Where crypto fits What to check first
Real-money casino Each state licenses real-money operators, and the operator applies for that license Payment rail for deposits and withdrawals, subject to state and federal rules Which states you can lawfully serve, and the application timeline in each
Sweepstakes-style casino Not a state gaming license. The model rests on a sweepstakes legal framework, which counsel should review Depends on your payment setup and on counsel’s review of your coin and redemption flow State by state restrictions on sweepstakes games, and the structure of your rules and redemption flow
Launch outside the US first The licensing authority of the markets you target Depends on the rules of each target market Local law in each target market. A license for one market does not cover another
Platform and operations stack You choose a provider or build in house Wallet, fiat on-ramp, KYC and fraud checks all have to work together Which parts the provider runs for you, and which stay with your team. For example, our platform integrates fiat and crypto payments, player KYC and anti-fraud checks in one stack

For the sweepstakes path, our earlier guide on sweepstakes casino legal steps for operators goes through the checklist in more detail.

What should you plan for besides the license?

Most launch delays come from the operating stack, not from the idea. Before you commit, list who will run each of these:

  1. Payments. Crypto deposits, fiat deposits, withdrawals and reconciliation. Our post on crypto and fiat payment integration for iGaming covers what to compare.
  2. Player verification. KYC checks suited to the markets you serve.
  3. Fraud and bonus abuse. Anti-fraud and anti-bonus-abuse rules need to be in place from day one, whichever payment method players use.
  4. Game content. Casino games from studios you can contract through your platform.
  5. Support and retention. 24/7 player support, CRM messages and affiliate tracking.
  6. Responsible gaming. Player limits and self-exclusion tools that match the rules of the markets you serve.

If you do not want to build this yourself, our guide to launching an online casino without building the technology explains the white-label route.

How does Maincard help you launch a crypto casino?

A crypto casino needs payments, KYC, anti-fraud, support and licensing coverage working together, and most new operators do not want to assemble those from separate vendors. Maincard is a white-label provider: your brand sits on top, and our platform and operations team run the business behind it.

We provide the platform, design and launch, fiat and crypto payment integrations, player KYC, anti-fraud and anti-bonus-abuse tools, CRM and affiliate integration, and 24/7 support. Operators can launch under our Anjouan gaming license, and for the US we provide a sweepstakes-based framework supported by a legal opinion. US real-money casinos are licensed by each state, and the operator applies. You follow the laws of every market you target.

Frequently asked questions

Is it legal to run a crypto casino in the US?

It depends on the state and on the model. Real-money online casino play needs authorization from each state where players are located, and crypto does not replace that. Sweepstakes models follow a different framework. Review your exact plan with gaming counsel before launch.

Can I accept Bitcoin from US players?

Accepting a payment type is a separate question from whether your product is authorized in the player’s state. Even where the product is allowed, payment processors, banks and money transmission rules can apply. If your model involves administering or exchanging virtual currency, FinCEN guidance may apply to you.

Does a license from another country let me serve US players?

Not for US real-money play, where each state licenses operators itself. A license from another jurisdiction covers the markets it is valid for, so check the coverage for each market you plan to enter.

How does Maincard handle crypto payments and compliance checks?

We integrate fiat and crypto payments into the platform and run player KYC, anti-fraud and anti-bonus-abuse checks behind your brand. We also help you understand licensing terms and can arrange optional support through licensed third parties for compliance audits, regulatory filings and country-specific legal vetting. You remain responsible for following the laws of the markets you target.

What is the safest way to start?

Decide your target states or countries first, then pick the model that fits them, then choose the platform. Settling the legal fit before you pick a platform keeps the plan consistent. Write down the markets you will block as well as those you will serve.
